DDI Comm, Inc. Usage Policy
At DDI Comm, Inc., we prioritize the protection of our clients and strive to provide the best possible service. To ensure a positive experience for all, it is important for DDI Comm, Inc. customers to have a basic understanding of Internet functionality, acceptable Internet usage, and activities to avoid. We encourage the use of common sense as a guide to determine acceptable practices. Furthermore, it is advisable to exercise common sense when uploading files during periods of high Internet traffic. The following guidelines have been established to maintain the quality of our services:
Content:
All services offered by DDI Comm, Inc. may only be used for lawful purposes. It is strictly prohibited to transmit, store, or present any information, data, or material that violates United States Federal, State, or City laws. This includes, but is not limited to, copyrighted material, threatening or obscene content, trade secrets, violation of U.S. export restrictions, harassment, fraud, trafficking of obscene material, drug dealing, and any other illegal activities. By using our service, subscribers agree to indemnify and hold harmless DDI Comm, Inc. from any claims resulting from their use of the service that may cause harm to themselves or others.
Please note that pornography, sex-related merchandising, and any content that promotes illegal activities or may harm our servers or other servers on the Internet are strictly prohibited. This includes links to such materials. Examples of non-acceptable content or links include:
- Pirated software
- Hacker’s programs or archives
- Warez sites
- MP3 archives
DDI Comm, Inc. retains the sole authority to determine what constitutes a violation of this provision.
Server Resources:
Web sites that consume a significant amount of server resources, such as CPU usage, will be given the option to either pay an additional fee (based on the required resources) or reduce the resource usage to an acceptable level. Misuse of system resources, including excessive consumption of CPU time or storage space, allowing the use of mail services, mail forwarding capabilities, POP accounts, or auto responders for purposes other than the customer’s own account, resale of access to CGI scripts installed on DDI Comm, Inc.’s servers, or using a single customer account for third-party websites by allowing multiple domain pointers to reference pages within the customer’s site, will not be allowed. DDI Comm, Inc. reserves the right to determine what constitutes high server usage.
Excessive Bandwidth Usage:
The monthly bandwidth allowance is specified on your Plan’s Feature Page. We monitor bandwidth usage and will notify you if your traffic exceeds the allocated limit. Sites that exceed the traffic limits will be charged $5.00 per Gigabyte per month for the excess usage beyond the monthly allotment specified in the customer’s chosen plan.
Chat Rooms:
Clients are not permitted to install their own chat rooms. Chat rooms tend to consume a significant amount of system resources and are not offered as an account option. DDI Comm, Inc. may provide chat rooms under specific Plans (availability can be found on the comparison chart) for free or at a small additional fee, ensuring they meet most users’ needs without hindering server performance. Non-Java chat rooms (cgi or perl based) are not allowed.
Background Running Programs:
DDI Comm, Inc. may allow programs to run continuously in the background on an individual basis. However, an additional charge will be incurred based on the system resources utilized and the operational maintenance required. Customers wishing to run background programs should contact us prior to doing so.
IRC:
DDI Comm, Inc. strictly prohibits the operation of any kind of IRC (Internet Relay Chat) or IRC bots on our servers, regardless of their size.
MAIL CONFIGURATIONS
At DDI Comm, Inc., we provide support for e-mail connectivity to our servers. This means that you can connect directly to our servers by specifying the POP3, IMAP, and SMTP server names in your e-mail client. By doing so, you can receive e-mails on behalf of your domain. Please note that any requests for MX record changes to support alternative configurations may result in additional charges.
FOREIGN DOMAIN REGISTRATIONS
DDI Comm, Inc. is capable of hosting domains from any foreign registry. However, it is the user’s responsibility to register any domain that is not a .com, .org, .net, .biz, .info, or .edu domain. An .edu domain is specifically reserved for accredited, degree-granting educational institutions. Please be aware that DDI Comm, Inc. cannot guarantee the acquisition of an .edu domain, and if it is not approved by the InterNIC, you may be required to obtain an .org domain instead.
NET ABUSE USING E-MAIL
Engaging in net abuse activities through e-mail, such as spamming, from a DDI Comm, Inc. server, referring to a URL hosted on our server, or using an e-mail address maintained on our server, is strictly prohibited. This includes actions like using a non-existent e-mail return address for commercial solicitations, allowing third parties to spam in order to promote a website hosted by DDI Comm, Inc., trolling (posting provocative messages to incite responses), mail bombing (sending multiple messages without significant new content to the same user), subscribing someone else to a mailing list without their permission, cross-posting articles to newsgroups without permission, and displaying commercial advertisements. Generally, any form of commercial advertising in areas of the Internet not intended for such purposes is prohibited. The protection afforded by government laws does not apply to this practice. Violation of our spam policy will result in immediate termination of your account without warning or refund. Additionally, a $100 penalty will be imposed for each violation of our spam policy. We reserve the right to refuse or cancel service for known spammers. Furthermore, we retain the right to determine what constitutes a violation of this policy.
GENERAL NET ABUSE
Using copyrighted material without obtaining appropriate permission from the copyright holder is a direct violation of federal laws and will not be tolerated within the web pages hosted by DDI Comm, Inc. If you are not a customer of DDI Comm, Inc. but believe that one of our customers is infringing on one or more copyright laws, please promptly email hosting@ddi-comm.com with the URL of the site and specific details regarding the alleged copyright violation. If the material is confirmed to be in violation of copyright, we will provide the customer/site owner an opportunity to remove the material immediately. Failure to remove the material within 48 hours of notice will result in account suspension until compliance is achieved.
Linking to another website for content and graphics materials without permission is considered “bandwidth theft.” Although not currently governed by federal, state, or local laws, DDI Comm, Inc. does not permit such activities. If you have content that is being directly linked on the pages of one of our customers without your permission, please immediately contact us at email_hosting@ddi-comm.com. Provide us with the site URL and specific details of the linked material. We will investigate the matter, and if a violation is found, we will give the customer/site owner an opportunity to rectify the issue by removing the direct links. If the material is not removed within 48 hours of notice of the violation, we will disable the account until the customer/site owner complies with our request to remove the material.
Any client of DDI Comm, Inc. found to be in violation of copyright laws or engaging in bandwidth theft and whose site is disabled due to non-compliance within the stated 48-hour period will not receive any refunds for the resulting downtime.
SERVER ABUSE
Any attempts to undermine or cause harm to a server owned by DDI Comm, Inc. or the use of an email address maintained on a DDI Comm, Inc. machine are strictly prohibited. We reserve the right to deactivate any script, even our own, if it is used in a manner that poses a threat to the performance of our network.
All sub-networks of DDI Comm, Inc. must adhere to the above policies. Failure to comply with any of the guidelines mentioned above will result in immediate account deactivation. We reserve the right to remove any account, whether deactivated or not, with 10 days’ notice, except in cases of spamming, which will warrant immediate removal without any refunds.
Complaints regarding policy violators should be reported to hosting@ddi-comm.com. Each complaint will be thoroughly investigated. DDI Comm, Inc. retains the right to fully examine any reported violations and determine the appropriate consequences.
DOMAIN TRANSFER
We will initiate the process to transfer your domain to our server.
Your responsibilities as the domain owner:
If you have not received any confirmation email from InterNIC to confirm the transfer of your domain within 2 days, you must inform us immediately.
If you did not receive a confirmation email from InterNIC, it may be because your original administrative email with InterNIC is:
- No longer valid, or
- Misspelled
As the domain owner, it is your responsibility to ensure that the “Administrator” email address registered with InterNIC is correctly spelled and up to date.
Important: The “Administrator” email address registered with InterNIC is the primary means of communication for confirming your domain transfer request. If there are any misspellings or if you have changed your email address without informing InterNIC or DDI Comm, Inc., the domain transfer will not be successful.
Please note that DDI Comm, Inc. cannot be held responsible for any untransferred domains due to invalid or incorrectly spelled email addresses with InterNIC. If your email address is not valid or if your domain transfer is not completed within 7 days, please contact us for further assistance.
It’s important to note that the services provided by DDI Comm, Inc. will commence from the day we set up your site, regardless of whether your domain has been successfully transferred.
BILLING POLICY
You have the option to pay for your hosting fees using a credit or debit card through the secure order form. All hosting fees are billed monthly on the first day of each month and must be paid in advance. Alternatively, you may choose to establish open credit with payments due 15 days after the invoice date or as per established terms.
If your account falls into arrears due to credit card refusal, you will be notified via email. If you change your email address, please inform us at hosting@ddi-comm.com.
30-DAY MONEY BACK GUARANTEE
Our plans come with a 30-day money-back guarantee. If you are unsatisfied with our service for any reason, you can receive a full refund by canceling your account within 30 days of activation. Please note that refunds for domain registration, if performed by us, are not available under any circumstances. Requests for cancellation must be submitted in writing via email, regular mail, or fax. We do not accept cancellations over the telephone. This refund policy excludes fees for website design or services other than hosting fees.
ALL OTHER REFUNDS
DDI Comm, Inc. does not offer refunds for periods shorter than 30 days. If you choose to cancel, the beginning of the next month will be considered your cancellation date.
CANCELLATION
To cancel your site, DDI Comm, Inc. requires written notice at least 14 days before the first day of your billing cycle. The notice must be sent to our address of record through the USPS. If you cancel with less than 14 days’ notice or after the due date, your account will be charged the full amount for the entire billing cycle.
LATE PAYMENT AND REACTIVATION FEES (RECONNECTION)
A late fee per month will be imposed on any unpaid balance that remains outstanding for more than 30 days from the date of the invoice. If your account has been suspended due to non-payment, a reconnection fee of $50.00 must be paid, along with any outstanding balance, to reactivate your account. Ongoing monthly fees will continue to accrue while your account is suspended. Please refer to the Terms of Service for any additional fees that may be applicable.
Please note that these policies are subject to change without notice. DDI Comm, Inc. reserves the right to refuse service to anyone or deactivate any account at our sole discretion.
